These Terms of Use form integral part of SMARC’s Privacy Declaration for Token App.
The Token App will not always be available and may have some faults. It is provided on an “as is,” and “as available” basis and, to the extent permitted by law, made without warranties of any kind. We reserve the right to modify, delete, suspend or discontinue, temporarily or permanently, the Token App, the information, functionalities or transactions available through it.
“SMART CONTAINERS” and other marks and logos are trademarks of Smart Containers Group AG, Switzerland. All trademarks not owned by SMARC that appear in the Token App are the property of the respective owner. The Token App, including all software, algorithms and content, is protected by copyright and other intellectual property laws and is the property of us, our developers, service-providers or subcontractors. All such rights are reserved. Except as expressly granted herein, you do not acquire any rights, title or interest in or relating to the Token App.
You must not misuse the Token App by knowingly introducing viruses or other material which is malicious or technologically harmful or attack the Token App via a denial-of-service attack or use data mining, robots or similar data gathering and extraction tools. You shall not use the Token App for purposes for which it is not intended or against the principles of good faith. A breach of this provision may constitute a criminal offence and we may report you to the relevant authorities.
You may create a hyperlink to our Token App from another website, social media channel or document without our prior written consent, subject to the following: no such hyperlink (i) implies that we endorse products, services or content of, or available through, the website, social media channel or document on which you place such link; (ii) displays any trademark(s) used on the Token App without our permission; (iii) is placed on a website, social media channel or document that contains content that is unlawful, threatening, defamatory, obscene, or could constitute or encourage conduct that would be considered a criminal offence or breach of any law or that, in SMARC’s sole interpretation, harms or may harm the interests or reputation of SMARC or the businesses we work with; or (iv) portrays us, our employees or directors or the businesses we work with in a false, misleading, derogatory, or otherwise offensive manner. We reserve the right to request at any time in our sole discretion for any reason that any link you create to our Token App from another website, social media channel or document be removed.
Access to or use of our Token App (or materials in the Token App) may be prohibited by law in certain countries or jurisdictions. You are responsible for compliance with all laws and regulations applicable to you.
We may suspend or exclude your access to our Token App, including if we reasonably believe that (i) data provided by you is incomplete or incorrect, and/or (ii) you are using the Token App in any way that is contrary to these Token App Terms or otherwise in a harmful way. You are not entitled to claim damages in such cases.
